Optional Townsend Water Heater Coverage (for oilheat water heaters)
- Coverage includes burner parts, aquastats controls and emergency switch.
- Annual performance check will be performed in conjunction with the conservation tune up of your heating system.
TERMS & CONDITIONS FOR GOLDGUARD, HOMEGUARD, VALUEGUARD, & GASGUARD
General Conditions
- Service plan coverage is contingent on inspection of the heating system by Townsend Energy.
- Townsend Energy reserves the right to inspect all heating equipment and refuse to perform any service or repair work on equipment deemed unsatisfactory.
- Service performed that is not explicitly listed on the contract will be charged at the prevailing rate.
- Townsend Energy reserves the right to cancel the plan upon 10 days written notice.
- Customer's account must be in good standing.
- Customer agrees not to purchase fuel oil from other sources.
- Annual tune-up reminder cards will be mailed once a year and tune-ups are scheduled by appointment only during normal business hours. It is the customer's responsibility to arrange this appointment for this very important service.
Other conditions:
Townsend Energy will not accept responsibility for the loss of heat in any unoccupied buildings, for delay or damages resulting from fires, accidents, power interruptions, water in basement, water in storage tank, and/or lines, labor difficulties, acts of the Government, flood, war, hurricanes, earthquakes, or any acts of God, or other causes beyond our control; or for any loss or damage caused directly or indirectly by services performed, for any consequential or special damage of any kind whatsoever, for any reason.
Exclusions
- This agreement does not cover replacement of a complete boiler, furnace, burner, hot water heater (indirect or oil-fired), mechanical chimney (power venter), tankless coil, radiant heat, humidifier or piping, baffles, oil lines, oil storage tanks, auxiliary lift pumps, electric wiring, domestic plumbing, draining of expansion tanks and purging of radiators or any parts or services not explicitly mentioned in this agreement.
- Townsend Energy is not liable for any environmental pollution or pollution cleanup due to tank rupture, oil line leak, or any contamination resulting from the oil distribution system.
TERMS & CONDITIONS FOR COOLGUARD
General Conditions
- If you have multiple systems, you must have a service plan for each.
- The system check-up as outlined should be performed once during the term of this service plan and it is the customer's responsibility to arrange for this service.
- The customer's right to the check-up expires at the end of each coverage year and no credit will be issued if the check-up is not performed.
- Townsend Energy reserves the right to inspect and approve the equipment covered prior to accepting the service plan. Initial repairs which might be required to put the air conditioning system in acceptable condition are not covered.
- This service plan is for ordinary residential systems up to 5 tons of cooling.
- The length of this service plan is one year. It will automatically renew at that time unless Townsend Energy is notified of cancellation in writing thirty (30) days prior.
- Customer's account must be in good standing to be covered by this service plan.
- Services performed which are not explicitly listed will be charged at the prevailing rate.
- This service plan may be terminated at any time by either party, without refund.
- Service work performed by anyone other than Townsend Energy may invalidate this plan.

Townsend Energy will not accept responsibility for the loss of heat in any unoccupied buildings, for delay or damages resulting from fires, accidents, power interruptions, water in basement, water in storage tank, and/or lines, labor difficulties, acts of the Government, flood, war, hurricanes, earthquakes, or any acts of God, or other causes beyond our control; or for any loss or damage caused directly or indirectly by services performed, for any consequential or special damage of any kind whatsoever, for any reason.
Exclusions:
- This service plan does NOT cover parts and labor costs caused by: tripped circuit breakers, electrical wiring, incorrect thermostat settings, Freon, refrigerant leak repairs, frozen condensate drain line in the attic, frozen evaporators, replacement of complete a/c system or any EPA cleanup costs.
- This service plan does not cover liability or damages resulting from failure of the equipment or consequential damages resulting in delays or inability to supply parts caused by, or resulting from, causes out of Townsend Energy's control, or at unattended homes.
- Townsend Energy will not be responsible for replacement of obsolete or unavailable parts.
- No refrigerants of any type are covered under this plan.
